Terms of Service

1. Acceptance of Terms

By accessing or using Odyssa (“the Service”), including the website at odyssa.net and the Odyssa mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Odyssa is an AI-powered trip planning platform that helps users create travel itineraries, manage trip logistics, track expenses, collaborate with travel companions, and access destination information. The Service uses artificial intelligence (Google Gemini) to generate itinerary suggestions based on user preferences.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years old to create an account
  • One person may not maintain more than one account
  • You are responsible for all activity that occurs under your account

4. User Content

“User Content” refers to any data, text, photos, documents, or other materials you upload, create, or share through the Service, including trip details, itineraries, photos, documents, expenses, and packing lists.

  • You retain ownership of all User Content you create
  • You grant Odyssa a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you
  • You are responsible for ensuring you have the right to upload any content you share
  • You agree not to upload content that is illegal, harmful, or infringes on others' rights

5. AI-Generated Content

Odyssa uses AI (Google Gemini) to generate trip itineraries, destination briefings, packing suggestions, and other recommendations. Regarding AI-generated content:

  • AI suggestions are provided for informational purposes only and should not be relied upon as the sole source of travel planning
  • We do not guarantee the accuracy, completeness, or timeliness of AI-generated information, including opening hours, prices, availability, or safety conditions
  • You are responsible for independently verifying important travel details such as visa requirements, health advisories, and booking confirmations
  • AI-generated itineraries may include places that have closed, changed hours, or modified their offerings since the AI's training data was compiled

6. Trip Collaboration

When you invite others to collaborate on a trip, you grant them access to view and (depending on their role) edit that trip's details. You are responsible for managing collaborator access and can revoke it at any time.

7. Third-Party Integrations

The Service integrates with third-party platforms including:

  • Google Calendar — for exporting itinerary events (requires your explicit permission)
  • Google Fit — for activity tracking during trips (requires your explicit permission)
  • Google Maps — for location and mapping services
  • Flight tracking services — for real-time flight status
  • Weather services — for destination weather forecasts
  • Currency exchange services — for real-time conversion rates

These integrations are subject to the respective third parties' terms and conditions. We are not responsible for the availability, accuracy, or functionality of third-party services.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means (bots, scrapers) to access the Service without permission
  • Upload malicious code, viruses, or harmful content
  • Abuse the AI assistant to generate content unrelated to trip planning
  • Resell, redistribute, or commercially exploit the Service without authorization
  • Circumvent any usage limits or access controls

9. Subscription Plans & Payments

Odyssa offers free and paid subscription tiers. The free tier provides limited access to features, while Odyssa Pro unlocks the full experience.

  • Free Plan: Limited to 2 active trips and 5 AI assistant messages per trip. Calendar sync, collaboration, photo storage, live flight tracking, and activity tracking are not available on the free plan.
  • Pro Plan ($5/month or $36/year): Unlimited trips, unlimited AI messages, and full access to all features including calendar sync, collaboration, photo storage, live flight tracking, and activity tracking.
  • Payments: Web subscriptions are processed through Square. Mobile subscriptions are processed through the respective app store (Google Play or Apple App Store).
  • Promo Codes: Promotional codes may be issued at our discretion and grant lifetime Pro access. Codes are single-use and non-transferable.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period. No refunds are provided for partial billing periods.
  • Price Changes: We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect on their account.
  • Legacy Users: Users who registered before the introduction of subscription plans retain lifetime Pro access at no charge.

11. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted access
  • The Service may be temporarily unavailable for maintenance, updates, or unforeseen issues
  • We reserve the right to modify, suspend, or discontinue any feature of the Service at any time
  • We are not liable for any loss resulting from Service downtime or unavailability

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ODYSSA AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Travel disruptions, cancellations, or changes based on AI recommendations
  • Inaccurate information in AI-generated itineraries or destination briefings
  • Loss of data due to technical failures
  • Unauthorized access to your account due to compromised credentials
  • Actions taken by trip collaborators
  • Third-party service failures or data breaches

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

12. Account Termination

  • You may delete your account at any time by contacting us
  • We reserve the right to suspend or terminate accounts that violate these terms
  • Upon account deletion, your personal data and trip content will be permanently removed from our systems within 30 days
  • Data that has been shared with trip collaborators may persist in their view until the trip is deleted

13. Intellectual Property

The Odyssa name, logo, and all original content, features, and functionality of the Service are owned by Odyssa and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our explicit written consent.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify users of material changes by posting the updated terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration in accordance with applicable rules.
